Claiming a spot on ClaimEarth does not constitute ownership of, rights to, or any legal interest in the real-world land, property, or geographic location associated with that coordinate. ClaimEarth is a digital experience only. No transaction within the ClaimEarth app transfers any real estate, land rights, mineral rights, air rights, or any other property interest of any kind. Any reference to "claiming," "owning," or "your spot" within the app or its marketing materials refers exclusively to a digital designation within the ClaimEarth platform and has no legal significance in the real world.
Spot Retention and Subscription
Your claimed spot is retained only for the duration of an active ClaimEarth subscription. If your paid subscription lapses, expires, or is cancelled for any reason, your spot will be released and made available for other users to claim. Daruma Ventures LLC makes no guarantee that a previously held spot will be available for reclaiming after a subscription lapse. You are solely responsible for maintaining an active subscription to retain your spot.
GPS and Location Accuracy
ClaimEarth relies on GPS and device location services to determine and verify the geographic coordinates of claimed spots. GPS technology is inherently subject to inaccuracies, signal interference, and hardware limitations. Daruma Ventures LLC does not warrant the precision or accuracy of any location data and is not liable for any discrepancies between a displayed coordinate and any real-world location. Location accuracy may vary based on your device, environment, and network conditions.
Availability of Spots
The availability, configuration, and features of spots within ClaimEarth are subject to change at any time at the sole discretion of Daruma Ventures LLC. We reserve the right to remove, reassign, or modify any spot, including Gem locations, without prior notice. No spot is guaranteed to remain available or unchanged indefinitely. Daruma Ventures LLC is not liable for any loss resulting from the removal or modification of any spot.
Use at Your Own Risk
Your use of the ClaimEarth app and any reliance on the information provided is solely at your own risk. We assume no responsibility or liability for:
- Loss of a claimed spot due to subscription lapse or account termination
- Inaccuracies in GPS or location data
- Decisions made based on the digital designation of a spot
- Any expectation of real-world value associated with a claimed spot
- Changes to app features, spot availability, or platform functionality
